The Court, having considered the Unopposed Motion, hereby GRANTS it and ORDERS that the Motion for Attorney Fees and Litigation Expenses [Doc. # 255] filed by Defendant El Paso Properties, Inc. shall have the same effect under Federal Rule of Appellate Procedure 4(a)(4) as a timely motion under Rule 59. Therefore, any appeal of the June 5, 2007 Judgment entered in this case would not be due until thirty (30) days following a ruling on the motions for attorney fees.
