Tuttle of Holland & Hart LLP to withdraw as counsel of record for Defendant's Mountain Coal Company, LLC, Arch Western Resources, LLC and Arch Coal, Inc. in this matter for the following reasons: 1. Ms. Tuttle has accepted an offer of employment with Vail Resorts, Inc. as Senior

Corporate Counsel ­ Employment Law. As a result, she will be withdrawing from Holland & Hart, LLP effective September 30, 2006. 2. Johnson. Defendants' will continue to be represented by Holland & Hart, by Jeffrey T.

The withdrawal of counsel will not delay any aspect of this litigation or result in

prejudice to any party. As required by D.C.Colo.LCivR 7.1A, the undersigned has conferred with counsel for Plaintiffs, who have no objection to the granting of this motion. Neither do the Defendants' have an objection. WHEREFORE, Defendants' respectfully requests that the Court enter an order permitting Ms. Tuttle to withdraw as counsel for Defendants' in this matter.
