DEFENDANT'S NOTICE OF ERRORS IN ITS REPLY TO PLAINTIFF'S OPPOSITION TO DEFENDANT'S MOTION FOR RECONSIDERATION Defendant respectfully submits its notice of errors that were contained in Defendant's Reply to Plaintiff's Opposition to Defendant's Motion for Reconsideration, which was filed on July 18, 2008. These errors just recently came to the attention of the Government's counsel. The errors are primarily typographical errors and do not change the substance of the Government's arguments. The errors should be corrected as indicated: (1) Page 7, line 2, "did challenge" should be replaced by "did not challenge"; (2) Page 8, line 14, "Hawaii Housing Auth. v. Midkiff." should be replaced by "Hawaii Housing Auth. v. Midkiff," (3) Page 8, line 19, "Midkiff and Berman decisions" should be replaced by "Midkiff and Berman"; (4) Page 10, line 14, "TLA." should be replaced by "TLA.""; (5) Page 16, footnote 13, line 3-4, "Crocker v.," should be replaced with "Crocker v. United States"; (6) Page 18, line 4 "Wisonsin" should be replaced with "Wisconsin"; (7) Page 18, line 4, "four" should be replaced with "one"; and (8) Page 18, line 6, "planes" should be replaced with "plane".
