NOTICE OF SUPPLEMENTAL AUTHORITY
Plaintiff, Cuyahoga Metropolitan Housing Authority, respectfully gives notice to the Court and Defendant that it intends to rely on the May 18, 2004 decision of the United States Court of Claims in First Commerce Corp. v. United States, U.S. Court of Claims No. 92-731C, 2004 U.S. Claims LEXIS 121 (Fed.Cl. May 18, 2004) (copy attached), at the June 18, 2004 oral argument of the parties' motions for summary judgment. 1 In First Commerce Corp., the Court examined the history of the doctrine of judicial estoppel and its acceptance in the Court of Federal Claims and the Federal Circuit. The Court explained that the doctrine of judicial estoppel is "that where the party successfully urges a particular position in a legal proceeding, it is estopped from taking a contrary position in a subsequent proceeding where its interests have changed." Id., 2004 U.S. Claims Lexis at *16. Judicial Estoppel "is intended to protect the courts rather than the litigants," and its invocation therefore "lies within the court's discretion." Id.

As explained in Plaintiff's briefings before the Court which we filed before issuance of the First Commerce Corp. decision, the Government successfully took an inconsistent position in Park Village Apts. v. United States, 32 Fed.Cl. 441 (1994), regarding the interpretation and applicability of the 1986 Memorandum. The doctrine of judicial estoppel therefore applies to prevent the Government from taking inconsistent positions in different judicial proceedings as the exigencies of the moment dictate.
