DUTY TO AVOID UNNECESSARY COST OF SICRVICE OF SUMMONS
Rule 4 oI`lhe Federal Rules ol`(?ivil Procedure requires certain parties to cooperate in saving
unnecessary cost oI`scrvicc ofthe summons and the complaint. A defendant located in the
United States. who. after being notified of an action and asked to waive service ofsttntmotts
on behalf of a plaitttill located in tlte US, fails to do so will be required to bear the cost of
sttclt service unless good cause be shown for tltat dcl`endant's failttrc to sign and return rite
waiver.
It is not good cause fora lltilure to waive service that a party believes that the complaint is
unfounded, or that thc action has been brought in an improper place or in a court that laclas
_iurisdiction over the subiect 1ttattC1‘ ofthe action or over defendants person or property. A
defendant who waives service ofsummons retains all defenses and obiections. except any
relating to the summons or the service of summons. and may later object to tlieiurisdiction oflltc
Court or to the place to where the action has been lnotrgltt.
A defendant who waives service must within the time specified on the "Rcturn ol` Waiver"
form served on plaintiff. if unrepresentcd or on plaintiI`l`s attorney. it response to the ('omplaint
and mttst also lile a signed copy ofthe response with the Court. Iftlte answer or a motion is not
served within this time. a defaultjudgenient may he taken against that defendant. By waiving
service. a defendant is allowed more time to answer titan ifthe summons had been actually
