THE OSAGE NATION'S UNOPPOSEDMOTION FOR PROTECTION FOR EXTENSION OF TIME TO RESPONDTO DEFENDANT'S RULE 30(b)(6) DEPOSITION NOTICE AND REQUEST FOR PRODUCTION OF DOCUMENTS The Osage Nation respectfullymovesfor a two-weekextension time, to and including of September 12,2005,in which to comply with Defendant's Notice of Takingof DepositionUpon Oral Examinationand Request Productionof Documents for August29, 2005. In support for set of this motion, the Osage Nation states following: the 1. Due to the pressingdiscoveryschedule adopted the partiesin this proceeding, by

the Osage Nation requirestwo additionalweekswithin which to comply with the Defendant's document request presented underRCFC30(b)(6). 2. On August 8, 2005,Defendant served Osage the Nation with a depositionnotice

andrequest productionof documents.The documentrequest for requiresresponsive documents to be produced later thanAugust24, 2005. The depositionof the Osage no Nation's representative wasnoticedfor August 29,2005and is scheduled proceed that datein Pawhuska, to on Oklahoma. 3. The Osage Nation requiresadditionaltime to adequately respond Defendant's to

document request.The document request coversa wide rangeof topics. In addition,efforts to

comply with the documentrequest requireconsiderable research documents of extendingback 30 yearsand which are locatedin Pawhuska, Oklahoma. 4. In the two weekssinceit hadbeenservedwith the document request, Osage the

Nation hasinterviewedvariousindividualsto identify the Osage Nation's designee.In addition, the Osage Nation hasbeenpreoccupied with otherdiscovery-related tasksin this case. Specifically,the Osage Nation andDefendant havebeenengaged ajoint review of documents in locatedin the AmericanIndian Records Repositoryin Lenexa,Kansas.Furthermore, Osage the Nation continuesto review documents produced Defendant a weekly basis,manyof which by on areproducedin response the Osage to Nation's depositionnoticesandaccompanying document requests servedon Defendantin May 2004. Finally, depositions havebeentakenon eachday sincethe depositionnotice was servedanddepositions scheduled everyinterveningday are on excepttwo until the September 2005discoverydeadline. 1, 5.
