Pursuant to the court's Opinion and Order, filed March 7, 2007, the parties' Joint Status Report Proposing Judgment Amount, filed on May 4, 2007, defendant's filing of Incentive Fee Decisions on June 21, 2007, and the court's April 14, 2007 Order Directing Judgment, IT IS ORDERED AND ADJUDGED this date, pursuant to Rule 58, that judgment is in favor of the plaintiff in the following amounts: A. For the fire that occurred at 765 Bataan Court on August 23, 1996, $15,695.63, plus interest on that amount as provided in the Contract Disputes Act (CDA), calculated from September 12, 1996; For rent reductions based upon alleged excess downtime for February through June 2002, $7,506.33, plus interest on that amount as provided in the CDA, calculated from September 4, 2002; and For incentive fees for contract performance year 1998, $56,667.00, plus interest on the amount as provided in the CDA, calculated from March 29, 1999.

IT IS FURTHER ORDERED AND ADJUDGED that the court declares that plaintiff is entitled to receive the following incentive fees: A. B. C. For incentive fees for contract performance year 1999, $55,437.00, plus any interest as provided by law; For incentive fees for contract performance year 2000, $52,835.00, plus any interest as provided by law; and For incentive fees for contract performance year 2001, $53,614.00, plus any interest as provided by law.
