A Protective Order And T0 C0mpel Disccvery (D I. 156) requesting
the C0urt t0 0rder Defendant Pepper Hamilt0n t0 pr0duce f0r in
camera review certain d0cuments which Defendant had designated as
prctected by the att0rney-client privilege;
WHEREAS, 0n February 7, 2007, the C0urt held a disc0very
status c0nference after which the C0urt 0rally granted the
Trustee's M0ti0n F0r A Pr0tective Order And T0 C0mpel Disc0very 1
(D.I. 156) t0 the extent that the C0urt w0uld review d0cuments in

WHEREAS, Defendant submitted the d0cuments (31, 33, 38, 39, )

WHEREAS, by letter dated March 12, 2007, counsel for
Defendant informed the Court that all counsel had stipulated that
Defendant's voluntary production of the “May 15, 2002 draft
memorandum” (documents 31 and 33 on Defendant’s privilege log)
did not constitute a waiver of Defendant’s attorney—client
privilege with respect to other documents or issues;
NOW THEREFORE, IT IS HEREBY ORDERED that the Trustee’s
discovery request with respect to the “May 15, 2002 draft
memorandum” within its Motion To Compel (D.I. 156) is DENIED as
ITIOOIZ ;
IT IS FURTHER ORDERED that the additional documents
submitted by Defendant for in camera review are protected by the
attorney—client privilege.
