The parties also request that the trial be held in Seattle, Washington. The project site was San Nicolas Island, California. Some of the issues involve access logistics to San Nicolas Island which is accessible only by Government aircraft upon a limited -1-

schedule. If the Court believes that a site visit will be beneficial, the parties propose that it take place immediately before or after the trial. The parties may conduct the trial using electronic exhibits, if acceptable to the Court. The parties will ensure the courtroom is outfitted for an electronic trial.
