DEFENDANT'S STATUS REPORT, UPON BEHALF OF THE PARTIES Pursuant to the Court's order, upon behalf of the parties, defendant respectfully submits this status report. Plaintiff's counsel has read this report and concurs. The parties have entered into a signed settlement agreement. According to its terms, upon receipt of the settlement payment, Phylway will stipulate to the dismissal of this lawsuit with prejudice. Payment will be effected by a contract modification, which is being prepared by the United States Army Corps of Engineers.
