On July 22, 2005, Defendant filed a motion to dismiss for lack of jurisdiction pursuant to RCFC 12(b)(1). On October 27, 2005, Plaintiff filed a notice of nonopposition to Defendant's motion to dismiss stating Plaintiffs intent to represent its claim to the contracting officer with proper certification for a final decision. Accordingly, Defendant's unopposed motion is GRANTED, and the above-captioned action is DISMISSED without PREJUDICE.
