Plaintiff in this case seeks a refund of the federal communications excise tax for taxable quarters ended June 30, 2002, through June 30, 2005. On August 16, 2006, the parties stipulated to the voluntary dismissal, pursuant to Rule 41(a)(1), of plaintiff's refund claim for the taxable quarter ended March 31, 2002.

On August 31, 2006, plaintiff made an offer in compromise to settle the remaining issues in this case. Defendant has taken plaintiff's offer under advisement.
