NOTICE OF PROOF OF SERVICE OF SUBPOENA Plaintiff Tetra Tech EC, Inc. ("Tetra Tech"), by its counsel, pursuant to Rules 5(d) and 45(b)(1) of the United States Court of Federal Claims ("RCFC"), files this notice of proof of service of a subpoena on C. David Douthat for the production of documents on April 18, 2007. Mr. Douthat is retired from the Government. He was formerly a Director of Ordnance Programs for the Corps of Engineers and was disclosed as a person of interest in Plaintiff's Initial Disclosures. Attached hereto are the subpoena served on Mr. Douthat along with the attachments and accompanying cover letter, certificate of service and email evidencing prior notice to Government counsel, and the proof of service on Mr. Douthat. It is the understanding of Plaintiff's counsel that Mr. Douthat is complying with the subpoena after having contacted Government counsel. TETRA TECH EC, INC.
