JOINT STATUS REPORT Defendant, the United States, respectfully submits the following status report upon behalf of the parties. On September 25, 2006, the Court continued the stay in this case until November 27, 2006 to permit the parties an opportunity to settle this action. The parties will attempt to finalize the proposed partial

settlement in an expedited fashion. In addition, the parties are still in negotiations regarding plaintiff's other claims and they remain hopeful that they can settle those claims. However, so as not to cause undue delay,

the parties respectfully suggest that the Court set a deadline of January 12, 2006 to respond to whatever portion of the complaint remains in the case as of that date.
