As directed by the Court, counsel for the parties have discussed settlement of this case. Given the Court's conclusion in its April 9, 2008 order denying the defendant's motion for summary judgment based on the existence of genuine issues of fact, counsel for the parties believe that additional discovery is necessary to have meaningful settlement discussions and to prepare for trial in this case.

Accordingly, the parties request an additional 140 days from the date of this filing, to and including September 30, 2008, to conduct further discovery in this case, including any written discovery or discovery by deposition testimony.
