FORSGREN, TERRI LYNN * HAGER, and BARBARA ANN * THOMPSON, TRUSTEES, * * Plaintiff, * * v. * * THE UNITED STATES, * * Defendant. * ************************************* ORDER Presently before the court in the above-captioned case is Defendant's Motion to Dismiss for Lack of Jurisdiction, which seeks dismissal of plaintiff's complaint as untimely filed pursuant to Rule 12(b)(1). Mot. 1-2. Plaintiff argues that the statute of limitations found in 28 U.S.C. § 2501 is not jurisdictional and thus the motion should fall under RCFC 12(b)(6). Opp'n 2-5. Plaintiff also argues that the court should equitably toll the limitations period. Id. at 8-14; Compl. ¶ 97. A recent decision of the Supreme Court bears on the parties' arguments: John R. Sand & Gravel Co. v. United States, No. 06-1164, slip op. (S. Ct. Jan. 8, 2008) (affirming the judgment of the Federal Circuit, 457 F.3d 1345 (Fed. Cir. 2006)). Accordingly, the court will provide the parties with the opportunity to address the Supreme Court's decision. Defendant shall file a supplemental brief no later than Tuesday, February 5, 2008.
