At the present time, defendant is of the opinion that the case should proceed on summary judgment motions, rather than ADR. The parties were advised that the undersigned stands ready to discuss settlement possibilities with the parties at any time. The parties also shall notify the undersigned when motion practice has concluded, if such motion practice does not dispose of the case.
