JOINT STATUS REPORT Pursuant to the Court's July 26, 2006 Order, Plaintiff, Calcasieu Refining Company, on behalf of both of the parties, respectfully submits this Joint Status Report. The Court's July 26, 2006 Order directed the parties to file a Joint Status Report by September 12, 2006, if a decision were not issued by that date in Hermes Consolidated, Inc. v. United States, No. 02-1460C (Fed. Cl.); Valero Refining-Texas LP v. United States, No. 03-1916C (Fed. Cl.); El Paso Merchant Energy Petroleum Co. v. United States, No. 02-1094C (Fed. Cl.); ConocoPhillips & Phillips Petroleum Co. v. United States, No. 02-1367C (Fed. Cl.); or Sunoco, Inc. v. United States, No. 02-466C (Fed. Cl.). As of the filing of this Joint Status Report, a decision has not been issued in any of the above-cited cases. A decision, however, has been issued granting the government's Motion to Dismiss in the similarly situated case of La Gloria Oil and Gas Company v. United States, No. 02-465C (Fed. Cl. Aug. 28, 2006). The parties here understand that La Gloria Oil and Gas Company ("La Gloria") is evaluating its options for appeal. Accordingly, with the Court's concurrence, the parties jointly propose that this case remain stayed and that they file a Joint

Status Report upon the earlier of (1) fourteen days after La Gloria files a notice of appeal or the period for appeal expires or (2) fourteen days after a decision on DESC's Motion to Dismiss in one of the above-cited cases. Respectfully submitted,
