NOTICE OF FILING

Pursuant to this Court's Amended Scheduling Order dated May 21, 2007, the United States hereby files, under seal, the administrative record of the Army Corps of Engineers. Accordingly, we request that the record be maintained under seal pursuant to the protective order issued by this Court on May 21, 2007.1 The United States has not yet served the administrative record on plaintiff because plaintiff has not provided the United States with the Application for Access to Information Under Protective Order by Inside or Outside Counsel required by the protective order.

The Court requested that the administrative record be filed by paper copy. This notice will be filed electronically. An identical courtesy copy of this notice was placed with the paper copy of the administrative record, except that copy was labeled "Filed Under Seal," and this footnote was slightly different. That label referred to the administrative record, rather than this notice. The Government apologizes for any confusion.

Similarly, the United States has not yet served the administrative record on intervenors, because two business days have not passed since intervenors filed their Applications for Access to Information Under Protective Order by Inside or Outside Counsel, and defendant has not been able to obtain a waiver of the two day waiting period from plaintiff. Defendant has contacted both plaintiff and intervenors to obtain the required documents. Once defendant receives the appropriate documents from plaintiffs it will serve them with copies of the administrative record, and will certify service with the Court.
