ORDER The Plaintiff, an employee of the United States Army Reserve Command Headquarters at Fort McPherson, has filed a Civil Rights employment discrimination complaint pursuant to Title VII of the Civil Rights Act of 1964 (42 U.S.C. §2000e-16) (Title VII), the Equal Pay Act (29 U.S.C. §206(d)(1),1 and the Age Discrimination in Employment Act (ADEA) (29 U.S.C. 633a) against Francis J. Harvey, Secretary of the Army; the Department of the Army; and Kenneth N. Williamson, Chief Executive office, U.S. Army Reserve Command. [Doc. 1] On June 15, 2004, the defendants filed a Fed.R. Civ.P. 12(b)(1), (2), (3) and (6) Motion to Dismiss contending that the Plaintiff improperly named two defendants in

their individual and official capacities: the Department of the Army, and Kenneth N. Williamson in his official capacity. The only properly named Defendant in the Title VII and ADEA counts is the Secretary of the Army, Francis J. Harvey. See 42 U.S.C. §2000e16; See Bechtel v. U.S. Office of Personnel Management, 549 F. Supp. 111, 113 (N.G.Ga. 1982); Honeycutt v. Long, 861 F.2d 1346, 1348-49 (5th Cir. 1988); Welch v. Laney, 57 F.3d 1004, 1010-11 (11th Cir. 1995). The Defendants also assert that the Plaintiff failed to timely assert her claim of a discriminatory denial of promotion, as the action denying her a promotion took place in 1999 but she did not file an administrative complaint until January 2002, more than three years thereafter. See 29 C.F.R. §1614.105 (a)(1); Manning v. Carlin, 786 F.2d 1108 (11th Cir., 1986). Defendants also contend that this Court lacks subject matter jurisdiction over any claim in excess of $10,000.00. This Court is compelled to agree with each of the Defendant's arguments. IT IS THEREFORE ORDERED that The Department of the Army and Kenneth N. Williamson are hereby DISMISSED as Defendants in both their official and individual capacities. IT IS FURTHER ORDERED that, in the event the Plaintiff claims more than $10,000.00 in, inter alia, lost wages, this case must be transferred to the United States Court of Claims.
