No. 08-133C (Judge Sweeney)

DEFENDANT'S UNOPPOSED MOTION TO CORRECT ADMINISTRATIVE RECORD Defendant, the United States, respectfully moves to correct certain errors in the administrative record we filed on March 14, 2008. We respectfully move to correct the record in the following manner: 1) Include in the administrative record, at Tab 41, page numbers 4704.1-4704.39, Attachment 1 to this motion. Although this document was a part of the record before the Government Accountability Office ("GAO"), it was inadvertently excluded from the administrative record filed on March 14, 2008.1

We also note that pages 4531-4549 and 4571-4609 were inadvertently included in Tab 41. The Government does not anticipate that the inadvertently included or excluded pages of Tab 41 will have any effect upon the outcome of the suit.

2) Replace Tab 66 in the administrative record with Attachment 2 to this motion. Attachment 2 is the public version of the GAO's January 31, 2008 decision. All but the first page was inadvertently excluded from the administrative record. 3) Replace the index filed with the administrative record with Attachment 3 to this motion. In the original index, Tabs 16 and 17 were inadvertently reversed. Tabs 47 and 48 were also inadvertently reversed in the original index.2 Neither plaintiff nor defendant-intervenor object to this motion. Therefore, we respectfully request that the Court correct the administrative record in the manner described above.

Additionally, we corrected a typo in Tab 37 of the index. 2
