Neither party, in its Appendix A filings or in the joint exhibit list, is required to note objections to exhibits in order to preserve those objections. 2. The parties stipulate to the admissibility of the documents listed below, provided that the document is used in the examination of any witness at trial and discussed by the witness, even if that witness could not authenticate the document. However, documents whose admissibility has otherwise been stipulated to need not be used in the examination of a witness at trial if the document was referred to in the text or exhibits of an expert report or in a demonstrative exhibit used by an expert witness at trial, but mere inclusion of the document in an expert report as a document relied upon in the preparation of that report does not suffice to obviate the need to use the document in the examination of a witness at trial. Only the admissibility of typewritten content, and not of handwritten content, is stipulated to. This stipulation notwithstanding, objections going to whether the document is complete or whether it is a composite of multiple documents are not waived. That a document has not been included in this stipulation does not carry any implication with respect to the admissibility of that document. Each party may add to its exhibit list up to 25 exhibits (other than demonstrative exhibits) without objection as to the timeliness of such designations, provided that no such new exhibit can be used at trial without its being provided to the other side at least 48 hours in advance.
