DEFENDANT'S MOTION TO FILE SUPPLEMENTAL APPENDIX MATERIALS Defendant respectfully requests that this Court permit defendant to file supplemental materials in the appendix in this case. Counsel for plaintiffs Scott and White, Texas Health Choice, and GHS Bluelincs consent to this motion. We propose to submit two documents: 1. FEHBP Letter, No. 97-8, Community-Rated Carriers, United States Office of Personnel Management, Office of Insurance Programs, March 7, 1997 2. FEHBP Letter, No. 97-10, Community-Rated Carriers, United States Office of Personnel Management, Office of Insurance Programs, April 2, 1997. These materials are guidelines and instructions that the Office of Personnel Management (OPM) forwarded to community rated carriers who participated in the Federal 1

Employees Health Benefits Act (FEHBA), 5 U.S.C. ยง8901 et seq, for the years 1997 and 1998. They are representative of OPM's guidelines for these matters. OPM relied upon these materials when performing a rate reconciliation. Because there are significant differences between a rate reconciliation, and nonreconciliation of rates when a provider chooses to exit the FEHBA Program, these materials will assist the court in understanding the complexities of the community rated programs and rate reconciliation. The documents are be labeled PDF GHS Health. The pagination starts from the last page of the appendix filed for GHE Bluelincs and starts at Appendix page 532. Conclusion Accordingly, defendant respectfully requests that this Court permit defendant to file supplemental materials in the appendix as described above. Respectfully submitted, PETER D.
