Notice is hereby given that the Debtor in Possession has filed an Application to employ Please further be advised that the above-named is a creditor of the estate. Section 1107(b) of the Bankruptcy Code provides that an attorney or accountant is not disqualified from employment solely because of such employment by the debtor before the commencement of the case. Section 327(a) of the Bankruptcy Code provides that a professional must be a disinterested person and ยง 101(14) of the Bankruptcy Code provides in part that a disinterested person means a person that is not a creditor.
Notice is further given that if you object to the entry of an order allowing the Debtor in Possession to employ the above-named professional you must object in writing by filing with the Office of the Clerk of the above-entitled Court your written objection on or before* at 605 West Fourth Avenue, Suite 138, Anchorage, Alaska 99501-2296, and serve a copy on the undersigned on or before said date. The application above referred to may be inspected at the Office of the Clerk of the Bankruptcy Court at the Old Federal Building, 605 West Fourth Avenue, Suite 138, Anchorage, Alaska or at the office of the undersigned. Should you fail to so object be further advised that the order employing (attorney/accountant) may be entered without further notice to you and any statutory disqualification will be deemed to have been waived.
