DISCOVERY ORDER Defendant's objection to producing malpractice insurance applications filed by or on behalf of Attorney Lagnese is sustained. Defendant's objections to producing documents issued by Attorney Lagnese to entities represented by her that memorialize the nature, terms, and/or scope of her representation are sustained, except to the extent that Attorney Lagnese has been engaged to opine about the effects of Connecticut malpractice or disciplinary proceedings in other states. Attorney Lagnese must

produce redacted copies of all engagement letters for any cases in which she was engaged to opine as described above by Thursday, March 31, 2005. Plaintiff would be entitled to representation documents regarding any cases in which Attorney Lagnese has offered expert testimony in the last four years. See Fed. R. Civ. P 26(a)(2)(B). However, Attorney Lagnese reports that she has not testified as an expert witness at trial or by deposition within in the past

five years. This is not a recommended order. This is a discovery ruling

order which is reviewable pursuant to the "clearly erroneous" statutory standard of review. 28 U.S.C. ยง 636 (b)(1)(A); Fed. R.

Civ. P. 6(a), 6(e) and 72(a); and Rule 2 of the Local Rules for United States Magistrate Judges. As such, it is an order of the

Court unless reversed or modified by the district judge upon motion timely made.
