Purchase Price: $__________________________________________ (Purchase Price MUST be stated) I, the Buyer/Owner (as described in Section 2 of this application) being an Indiana resident (as defined on the reverse side of this application), hereby acknowledge that the purchase transaction between myself and the seller of the horse described in Section 1 of this application is in fact a purchase that has been paid in full by me at the time of this application and not being paid for over time or through the horse's earnings. I further acknowledge that this transaction is not a "Paper Transaction" or "Straw Purchase" to make the horse eligible for restricted races in Indiana. In the event of any contested ownership of the horse stated in Section 1 of this application, I understand and agree that I bear the burden of proving bona fide ownership of such horse. In addition, I hereby agree to submit to the jurisdiction of the Indiana Horse Racing Commission (the "Commission") and to be bound by all its rules including eligibility for racing and ownership status found at 71 IAC 7-1-35. I understand that registration may be denied, revoked or suspended at any time and that other penalties may be incurred for misstatements or omissions in the foregoing application.

In the event that either myself or the Commission proceed with any administrative or civil action, suit or proceeding for fines, penalties or other disciplinary action arising out of or related to this application, I agree to be responsible for all fees and expenses, including reasonable attorneys' fees, relating to such proceedings which are incurred by both myself and the Commission in the event that the Commission's actions and/or position are upheld or if there is a final determination rendered which is adverse to me. In that event, I agree that the Commission shall be entitled to be reimbursed for all fees and expenses incurred by it in connection with such action, suit or proceeding, including reasonable attorneys' fees. INDIANA OWNED: Any Quarter Horse which was foaled outside of Indiana and whose owner or owners are ALL residents of Indiana. These horses must be registered by March 1, 2005 with the Indiana Horse Racing Commission and (Claiming and public sale horses excepted) The Indiana Owned Quarter Horse Program will phase out as follows: 2 year old, at the conclusion of the 2003 racing season; 3 year olds, at the conclusion of the2004 racing season; 4 year olds and older, at the conclusion of the 2005 racing season. INDIANA RESIDENT: The state where an individual's residence is located. "Residence," as used in the context of this statement means the place where an individual has their permanent home, at which that person remains when not called elsewhere for labor ~Continuation of Application and to which of person returns in Quarter repose. or other special or temporary purposes,Registration thatIndiana Owned seasons of Horse 2002~ It is a place a person has voluntarily fixed as a permanent habitation with an intent to remain in such place for an indefinite period. A person at any one time has but one residence and a residence cannot be lost until another gained. The IHRC may consider all relevant information when determining residency. The burden of proof is on the applicant claiming residency. REGISTRATION OF INDIANA OWNED HORSES WHICH ARE INTENDED TO COMPETE IN RESTRICTED RACES IN 2005: All horses wholly owned by Indiana residents must be registered with the Indiana Horse Racing Commission by March 1, 2005. All of these horses must be paid for in full by the owner at the time of registration. The Indiana Horse Racing Commission will not accept any purchases paid over time or by the horse's earnings. Each horse requires a separate application.

INDIANA RESIDENTS MAY PURCHASE HORSES AFTER MARCH 1, 2005 THROUGH THE FOLLOWING MEANS: Claiming Any horse claimed at a recognized North American race track by an Indiana resident is eligible. After claiming such horse, the resident must submit a registration application and a copy of the front and back side of the AQHA certificate documenting the claiming transfer to the Indiana Horse Racing Commission within fifteen (15) days of claim and before entering to race at a racetrack in Indiana. Public Auction The Indiana Horse Racing Commission will accept into the program any horse purchased from Public Auctions. Indiana residents must submit registration applications and a copy of the front and back side of the AQHA Certificate documenting purchase transfer by the Auction or Sale Company within thirty (30) days of purchase and before entering to race at a racetrack in Indiana. Private Purchase of Horses Which Were Registered By March 1, 2005 The Indiana Horse Racing Commission will not accept into the program any private purchase made after March 1, 2005 unless the horse was registered by March 1, 2005 by an Indiana resident and was re-sold to another Indiana resident or residents after March 1, 2005. In the event of a re-sale to another Indiana resident, a new registration application must be submitted to the Indiana Horse Racing Commission within fifteen (15) days of transaction and before entering to race at a racetrack in Indiana. Leases Leased horses are eligible to be registered as Indiana owned provided both lessee and lessor are all Indiana residents.
