The following sentence is imposed pursuant to the Sentencing Act of 1984. lThe sentence imposed is a downward departure pursuant
to U.S.S.G. §§ 5Kl .1 and 5Hl .4. The defendant is totally disabled and coniined to a Nursing Home due to a debilitating stroke in
January 2004 that rendered him permanently paralyzed on his left side. He is confined to a wheelchair, and his condition is
deteriorating. l
IMPRISONMENT R
The defendant is hereby sentenced to time served, with no term of superviseisl release.
CRIMINAL MONETARY PENALTIES l
The government’s motion pursuant to 18 U.S.C. § 3573, to waive the $100 sipecial assessment as uncollectible, is granted.
It is iiirther ordered that the defendant will notify the United States Attorneyi for this district within 30 days of any change of name,
residence or mailing address.
Counts 2, 3, 4, 5, 6, 7, and 8 are dismissed on motion of the United States.

CONDITIONS OF PROBATION/SUP QRVISED RELEASE I
In addition to the Standard Conditions listed below, the following indicated (I) Ndanclatory Conditions are imposed:
El (1) The defendant shall not commit another federal, state or local offense;
El (2) The defendant shall not unlawfully possess a controlled substance; l i
El (3) The defendant who is convicted for a domestic violence crime as defined in 1 U.S.C. section 356l(b) for the first time shall attend a public,
private, or private non-profit offender rehabilitation program that has been ap roved by the court, in consultation with a State Coalition
rigaénpt Djomestic Violence or other appropriate experts, if an approved prog m is available within a 50-mile radius of the legal residence of
t e e en ant;
lj (4) The defendant shall refrain from any unlawful use of a controlled substance cl submit to one drug test within 15 days of release on
supervised release and at least two periodic drug tests thereafter for use of a ontrolled substance;
El (5) if a fine is imposed and has not been paid upon release to supervised release, the defendant shall adhere to an installment schedule to pay that
me;
El (6) The defendant shall (A) make restitution in accordance with 18 `U.S.C. sectio s 2248, 2259, 2264, 2327, 3663, 3663A, and 3664; and (B) pay
the assessment imposed in accordance with 18 U.S.C. section 3013;
EI (7) A defendant convicted of a sexual offense as described in 18 U.S.C. sections 042(c)(4) shall report the address where the defendant will
reside and any subsequent change of residence to the probation officer respon ible for supervision, and shall register as a sex offender in any
State wheret e person resides, is employed, carries on a vocation or is a stud nt.
El (8) The defendant cooperate inthe collection of a DNA sample from the defendant.
While on supervised release, the defendant shall also comply with all of t e following Standard Conditions:
1. The defendant shall not leave the judicial district or other specified g ographic area without the permission of the court or
probation officer;
2. he defendant shall report to the probation officer as directed by the ourt or probation officer and shall submit a truthful and
complete written relport within the first five days of each month;
3. The defendant shal answer truthfully all inquiries by the jprobation o ficer and follow the instructions ofthe probation officer;
4. The defendant shall support the defendant’s dependents and meet o er family responsibilities (including-ibut not limited to,
complying with the terms of any court order or administrative proces pursuant to the law of a state, the istrict of Columbia,
or any other possession or territory of the United States reduirmg pa ents by the defendant for the support and maintenance
of an(y child or of a child andthe parent with whom the chi d is living);
5. The efendant shall work regular y at a lawful occupation unless exc l sed by the probation officer for schooling, training, or
other acceptable reasons;
6. The defendant shall notify the probation officer at least ten days prio to any change of residence or employment; _
7. The defendant shall refrain from excessive use of alcohol and shall n t purchase, possess, use, distribute, or administer any
controlled substance, or any paraphernalia related to any controlled s bstance, except as prescribed by a physician;
8. The defendant shall not frequent places where controlled substances re illegally so d, used, distributed, or administered, or
other places specified by the court;
9. The defendant shall not associate with any persons engaged in criminal activity, and shall not associate with any person
convicted of a felony unless granted permission to do so by the prob tion officer; _
10. The defendant shall permit a probation officer to visit the defendant t any time at home or elsewhere and shall permit
confiscation of any contraband observed in {plain view by the probati n officer;
1 1. The defendant shall notify the probation of icer within seventy-two h urs of being arrested or questioned by a law enforcement
officer;
12. The defendant shall not enter into any agreement to act as an informc or a special agent of a law enforcement agency without
the permission of the court;
13. The defendant shall pay the special assessment imposed or adhere to court—ordered installment schedule for the payment of
the special assessment; _ _ _ _
14. The defendant shall notify the probation officer of any material chan e in the defendant’s economic circumstances that might
affect the dcfendanfs ability to pay any unpaid amount ofrestitution, fines, or special assessments.
The defendant shall report to the Probation Office in the district to whic the defendant is released within 72 hours of release
from the custody of the U.S. Bureau of Prisons. (Delete if not applicable)
