Pursuant to Fed.R.Civ.P. § 6(b), the defendant, Kevin Foley, hereby requests an 5
extension of time of thirty (30) days, up to an including January 21, 2004, in which to
respond to the plaintiffs complaint. Given that the complaint was not received by T
defense counsel until December 22, 2003, the undersigned counsel needs additional time I
to meet with the defendant in order to fully review the facts and circumstances of the T
plaintiffs claims so as to properly plead to said complaint. The undersigned counsel has T
spoken with plaintiffs counsel and there is no objection to the Court’s granting of this
motion.
This is the defendant’s iirst motion for extension of time with respect to this .
pleading.
For the foregoing reasons, the defendant respectfully requests that this motion be
granted.
