MOTION TO COMPEL DEPOSITION AND FOR SANCTIONS Pursuant to Fed. R. Civ. P. 37(d) and Local Rule 37, the Plaintiffs hereby move that the Court enter an order (1) compelling the Defendants to produce Elizabeth Wacik for deposition; and (2) sanctioning the Defendants for their failure to comply with the rules of discovery by (i) precluding Defendants from offering evidence in support of their newly filed counterclaims and (ii) awarding Plaintiffs attorneys' fees and costs associated with the filing of this Motion.
