The plaintiff hereby objects to the defendants Motion To Dismiss the I

complaint pursuant to Rule l2(b)(l) of the Federal Rules of Civil Procedure on the basis I
of abstention. Plaintiff asserts before the Court that abstention is inappropriate because I
defendants’ argument is unsupported and fails to mention many of the undisputed facts, I
and repeatedly mischaracterize the statutory tiamework of the Psychiatric Security I
Review Board.
Moreover, plaintiff asserts before the Court that abstention is inappropriate because I
he is not seeking to enjoin pending state proceedings, abstention does not apply to this
case, the legal issues in the State proceedings are distinct. The reasons therefore are set
forth in the plaintiff s Declaration and Memorandum of Law in Opposition to defendants
