The stay requested Pursuant to Giggs v. Provident Consumer Discount Co. 459 U.S. 56, 58 (1982) (The filing of a notice of appeal is an event of jurisdictional significance- it confers jurisdiction on the court of appeals and divests the district court of its control over those aspects of the case involved in the appeal. See, e.g. United States v. Hitchmon 587 F. 2d 1357 (5th Cir. 1979.); USA v. Padilla (Camacho) case number 02-1242 (2nd Cir. 2002) and see Re: International Business Machines Corporation, case number 94-3071 (2nd Cir. 1995) and its comments; United States v. International Business Machines Corp, 857 F. Supp. 1089 (S.D.N.Y. 1994) Judge Edelstein denied recusal motion and deferred

consideration of the motion to terminate the consent decree until disposition of the pending motion for a writ of mandamus.
