PETITION FOR REMOVAL & DESTRUCTION OF DERELICT MOBILE HOME

local official alleges the following:
A mobile home is located at ______________________________________ in the county of ______________, on the property of ___________________________. Description of mobile home: Make _______________________________, Model ______________________________, Vehicle Identification Number ________________________. The mobile home is not connected to electricity and/or a source of safe potable water supply sufficient for normal residential needs, or not connected to a Department of Environmental Control approved wastewater disposal system, or unoccupied and has been unoccupied for at least 30 days. Petitioner further alleges the following as clear and convincing evidence to the court that the occupant does not intend to return on a temporary or permanent basis: __________________________________________________________________ __________________________________________________________________ _________________________________________________________________. The mobile home is so damaged, decayed, dilapidated, unsanitary, unsafe, or vermin-infested that it creates a hazard to the health or safety of the occupants, the persons using the mobile home, or the public. Petitioner previously applied to the local official to have the mobile home inspected and has received written confirmation from said local official that the mobile home has been inspected and meets the requirements for removal and disposal as provided in § 6-1-150 (A)(1) (written confirmation attached). A landlord/tenant relationship does does not exist between the landowner and registered owner of the mobile home. (If a landlord/tenant relationship exists, landowner must eject the tenant through judicial process prior to the removal and sale/destruction of the mobile home.)

Wherefore, Petitioner prays that this Court issue an order declaring the aforementioned mobile home, located at _________________________________, in _______________ County, to be a derelict mobile home pursuant to § 6-1-150, and order the removal and destruction or removal and sale of the mobile home after petitioner has complied with the notice and posting requirements of § 6-1-150 and § 29-15-10.
