Appellee, RHC Acquisition, Inc. ("RHC"), a party to the order which is
the subject of this appeal, by and through its undersigned counsel, hereby joins in
Appellee Francis A. Monaco, Jr., Chapter ll Trustee’s Motion to Dismiss Appeal (the
"Motion") and the Memorandum of Law in Support of Appellee Francis A. Monaco, Jr.,
Chapter ll Trustee’s Motion to Dismiss Appeal as Moot (the "Memorandum") and
hereby incorporates the factual and legal arguments set forth in the Motion and
Memorandum.

WHEREFORE, for the reasons and authorities cited herein, RHC
requests that the Court dismiss this appeal as moot, grant RHC costs of the appeal, and
