referenced action.
I write to bring to the Court’s attention an argument in the Reply Brief in Support
of Defendant RC Components, Incfs Motion for Summary .iudg.ment (tne "Re_ply Brief") tiiat is
no longer applicaole in liglit of Plaintiff s tiling of a sworn and executed copy of the Affidavit of
Michael Rivers (the "Rivers Aftidavit’”), on February 9, 2007.] Because Plaintiff initialiy tiled
an nnexeented and unsworn copy of the Rivers Affidavit with the Opposition, RC argned in the
Reply Brief that the Court should disregard the Rivers Affidavit.
Although tiled after Plaintiffs deadline to file the Opposition, Plaintiffs
corrective February 9 tiling nialres RC’s argument on this issue in pages 1 and 2 of the Reply
Bricfno longer applicabie.
