STIPULATION OF DISMISSAL Pursuant to the Settlement Agreement read into the record on January 29, 2008 (D.I. 119 at 319-22), IT IS HEREBY STIPULATED by the parties, subject to approval of the Court, pursuant to Fed. R. Civ. P. 41(a)(1), that this action, including all claims and counterclaims, is dismissed with prejudice, with each party to bear its own costs and attorneys' fees.
