Dear Judge Sleet:
1 write to update the Court on the status ofthe Motion to Withdraw as Counsel filed on
November 7, 2007 [Docket No. 16] (the "Motion"). On November 21, 2007, I filed an
Affidavit of Service indicating that both copies of the Motion were delivered - one to
Mr. Bender’s home address and one to the care facility where we understand Mr.
Bender may be temporarily residing. Based on conversation with counsel for the
defendant, Mr. Durstein, 1 understand that defendant does not oppose our request to
withdraw as counsel, but asks that Mr. Bender be required to appear at any conference
concerning the Motion. Under the current scheduling order, discovery is scheduled to
close on December 19, 2007.
Counsel is available at the Coutt’s convenience to address the pending Motion.
