I write on behalf of third-party defendant STMicroelectronics, Inc. (“STM”) in
connection with the September i8, 2007 Order regarding consent to Your I-ionor’s determination
of ali pending motions. (DI. 61)
With regard to the form of decision on STMicroelectronics, lnc.’s Motion To
Dismiss For Failure to State A Claim Or, ln The Alternative, To Disrniss In Favor Of The First
Fiied State Court Action (D.l. 37), STM is content to have Your Honor decide the motion in
whatever form Your Honor believes will be most useful to the Court. The Rule 12(b)(6) portion
of STM’s motion is substantive and dispositive, and thus may not be amenabie to disposition in
an abbreviated order. Nonetheless, STM is content to have Your Honor issue an abbreviated
order, if Your Honor decides such a course of action is appropriate after reviewing the subject of
the motion.
As to the Motion To Dismiss ln Favor Of The First Filed State Court Action,
STM concurs with Your Honor°s observation that such motions are usually amenable to
disposition in abbreviated forrn.
