NOTICE OF DEPOSITION OF CHING-HWA CHEN To: All Counsel on the Attached Service List PLEASE TAKE NOTICE that, pursuant to Rule 30 of the Federal Rules of Civil Procedure, counsel for Defendants will take the deposition by oral examination of Ching-Hwa Chen on January 16, 2008 immediately following the completion of Freescale's Third Notice of Deposition of Promos Technologies at the office of Jones Day, 1755 Embarcadero Road, Palo Alto, CA 94303, to which Mr. Chen has been designated by ProMOS to testify. The deposition will be recorded by videotape, as well as stenographically, before a Notary Public or other officer authorized to administer oaths and will continue from day to day until completed.
