U Pursuant to Fed. R. Civ. P. l2(‘o)(6), Third—Party Defendant Scientific Learning
Corporation I"SLC") respectfully moves this Court to dismiss Third~Pa1ty Plaintiff Christina
School District’s Third-Party Complaint inthe above—captioned action for failure to state a claim
upon which relief can be granted.
The grounds for this Motion are set forth in SLC’s Opening Brief in Support, tiled
contemporaneously herewith. A proposed Order is attached to this Motion for the Court’s
convenience.
