Dear Judge Farnan:
As you know we represent the plaintifi Atlasjet, in the above-referenced matter. As discussed in our
March 26, 2008 letter, the Honorable Richard J. Sullivan has not ruled whether jurisdiction can be
maintained in New York. As of this date Judge Sullivan still has not ruled in the matter. Pending the
outcome of that Motion, the action in Delaware may be dismissed.
lf the Court views it necessary, we can file a motion to stay the action here in Delaware pending the
ruling in New York. At this time we request an additional leave from the Court’s requirement of tiling
the Rule 16(b) statement.
