Sun Optics, Inc. ("Sun Optics") hereby moves the Court, pursuant to Rule 15(a) of the Federal Rules of Civil Procedure, for leave of this Court to file its First Amended Complaint, which is attached hereto as Exhibit A. A marked version of the First Amended Complaint is attached hereto as Exhibit B as required by D. Del. LR 15.1. Specifically, Sun Optics moves the Court for an order granting leave to file an amended complaint to (1) add a claim for infringement of U.S. Patent No. 7,188,739 against defendant FGX International, Inc. ("Foster Grant"), and (2) to clarify a typographical error in the prayer for relief. This motion is based on facts that the amendments will not prejudice Foster Grant, will not delay the case, and are required for justice. These facts and supporting argument are more particularly set forth in the supporting memorandum filed contemporaneously herewith. Therefore, Sun Optics respectfully requests that this Court enter an Order granting Sun Optics leave to file its First Amended Complaint. A Memorandum of Points an Authorities in Support of this Motion and a proposed Order are filed herewith.
