WHEREAS, Plaintitt woutd Iike to change the name of the Plaintiff in this action to
Moda Phatniaceuticals Inc. and Defeaidants have no objection;
IT IS HEREBY STIPULATED bythe parties hereto, subject to the approval ofthe Court,
that the name ofthe Piaintiff in this action be changed to Moda Pharmaceuticals Inc. and that the
