NOTICE OF APPEAL PLEASE TAKE NOTICE that American Classic Voyages Co., et al., by and through its undersigned counsel, hereby appeals to the United States District Court for the District of Delaware from each and every part of the Order of the United States Bankruptcy Court for the District of Delaware (Carey, B.J.) entered on the 27th day of April, 2007 (Docket No. 180) which: (i) held that the Plaintiffs have not proven that the Debtors were insolvent as required by Bankruptcy Code Section 547(b)(3); and (ii) entered judgment in favor of the Defendants and against the Plaintiffs.
