which the Court agreed to postpone the September 12, 2007 scheduling conference in this
matter), the parties to this action have consulted with the parties in the related action of Abbott
Laboratories v. Johnson & Johnson, Inc., C.A. No. 06—6l3—SLR, and have agreed to the enclosed
scheduling order, which is substantially similar to the one which Mr. Cottrell submitted to the
Court in that action on October 2, 2007.
