Goldfarb’ hereby responds to Shimko’s Motion To Strike. Goldfarb p
acknowledges that the deadline for dispositive motions was March 31, 2008.
However, counsel for Woodcock did not serve a copy of his pleading Goldfarb
until the second week of March. Goldfarb immediately prepared his joinder.
Moreover, it is certainly fair and promotes judicial economy to deal with the 0
defendants on an equal basis. In addition, Shimko has not dealt with deadlines
. imposed on him fairly as evidenced by Woodcock’s amended Motion for
Summary Judgment. Therefore, in the interest of fairness, Goldfarb moves this
Court to allow him to file the J oinder in Summary Judgment late.
