Procedure to Request Modification of Restraining Orders

If you are requesting that a Domestic Violence Restraining Order be modified to vacate all terms and conditions relating to personal conduct (restraining orders), you must complete the attached forms. The Court will consider your request for dismissal of the restraining order at a hearing. All other orders will remain in full force and effect. There is no fee for this court procedure. Instructions to Petitioner: 1. Complete the attached form ARequest for Modification of Domestic Violence Restraining Order After Hearing@. The Clerk of the Court will complete the ANotice of Hearing@ section. Complete the top portion only of the Order Modifying Domestic Violence Restraining Order After Hearing (Name, Address, Name of Parties, Case Number). 2. Take the completed forms to the Superior Court, Civil & Family Law Courthouse, Family Law Division at 3055 Cleveland Avenue, Santa Rosa. (Business hours are Mon. through Fri. 8:00am-4:30 pm) You may mail the completed forms to the Clerk at the above address if you prefer. However, you must include a self-addressed, stamped envelope so the Clerk can mail a notice of the hearing date to you. 3. 4. The Clerk will set a hearing date. You must appear at the hearing. At the hearing the Court will consider your request to vacate the restraining orders. If the judge grants your request to vacate the restraining orders, you will receive a copy of the Court=s order after the hearing. Once the Order has been signed by the Judge, the domestic violence restraining order will be removed from the law enforcement telecommunications system (CLETS).
